Concourt to hand down judgment in challenge to Restitution Amendment Act

Tomorrow in the Constitutional Court, judgment is expected in the case of Land Access Movement of South Africa (LAMOSA) and others v Chairperson of the National Council of Provinces and 13 others. The LRC and Webber Wentzel brought this case on behalf of LAMOSA, Nkuzi and Association For Rural Advancement (AFRA), as well as three Communal Property Associations, due to concerns raised around the public participation process of the Restitution Amendment Act, as well as the vagueness of "prioritising" existing land claims over new claims. The Restitution Amendment Act opened up the land claims process in South Africa.
